TERMS & CONDITIONS – TENOWI VILLA & TENOWI HOUSES

These Terms & Conditions (“Terms”) govern the booking, rental, occupancy, and use of the luxury villa (“Villa”) operated by the owner or authorized manager (“Owner”, “we”, “us”).

By completing a booking, making payment, accessing the Villa, or using the property, the guest (“Guest”, “you”) confirms that they have read, understood, and fully accepted these Terms, which constitute a legally binding agreement under the laws of Costa Rica.

1. BOOKING & ACCEPTANCE OF TERMS

1.1 These Terms apply to all bookings, whether made via the Owner’s website, direct communication, or any authorized booking channel.

1.2 Acceptance of these Terms is mandatory and occurs when:

  • A booking is confirmed, and/or
  • A payment is made, and/or
  • The Guest accesses or occupies the Villa.

1.3 If the Guest does not agree with these Terms, they must not proceed with the booking or use the Villa.

2. ELIGIBILITY & RESPONSIBILITY

2.1 The primary Guest must be at least 25 years of age and legally capable of entering into binding contracts.

2.2 The primary Guest is fully responsible for:

  • All occupants
  • Any visitors approved by the Owner
  • Compliance with these Terms by all persons on the property

2.3 Subletting, assigning, or transferring the booking is strictly prohibited.

3. RENTAL PURPOSE & OCCUPANCY

3.1 The Villa is rented exclusively for short-term residential accommodation.

3.2 No parties, events, gatherings, celebrations, or commercial activities are permitted at any time, including in outdoor areas.

3.3 The maximum occupancy stated at booking must not be exceeded under any circumstances.

4. PAYMENTS & PREPAYMENT, CANCELLATION, REFUND

4.1 A 50% prepayment of the total rental amount is required within 24 hours to confirm the booking, the rest payment of 50% latest on arrival day before check-in.

4.3 Accepted payment methods:

  • Credit card
  • Bank transfer

4. Failure to complete payment within the required timeframe may result in automatic cancellation without refund. There is Full Refund if canceled ≥30 days before check-in (arrival) and there is no Refund if canceled less than 30 days before check-in (arrival) or NO SHOW (not arrival at check-in date).

5. TRAVEL INSURANCE

5.1 We strongly recommend comprehensive travel insurance to cover unforeseen changes.

6. CHECK-IN, CHECK-OUT & ACCESS

6.1 Check-in time: from 3:00 PM

6.2 Check-out time: by 10:00 AM

6.3 Early check-in or late check-out is subject to availability and may incur additional charges.

6.4 Access codes, keys, or instructions must not be shared with unauthorized persons.

7. STRICT HOUSE RULES

7.1 Smoking

  • Smoking is strictly prohibited throughout the entire property, including:
    • Indoor areas
    • Semi-covered outdoor areas
  • Violation may result in immediate termination of stay and additional cleaning or damage charges.

7.2 Noise

  • Quiet hours: 10:00 PM – 8:00 AM
  • Excessive noise at any time is prohibited.

7.3 Pets

  • Pets are not allowed, unless explicitly approved in writing prior to arrival.

8. POOL & OUTDOOR AREAS

8.1 Use of the pool and all outdoor areas is entirely at the Guest’s own risk.

8.2 The Owner provides no lifeguard or supervision.

8.3 Children must be supervised at all times.

8.4 Glass, breakable items, or unsafe behavior near the pool are strictly prohibited.

9. DAMAGE, CLEANING & PROPERTY CARE

9.1 The Guest agrees to maintain the Villa in a clean, respectful, and orderly condition.

9.2 The Guest is liable for:

  • Any damage
  • Missing items
  • Excessive cleaning
  • Violations of these Terms

9.3 The Owner reserves the right to charge the Guest for repairs, replacements, or additional cleaning costs.

10. NO LIABILITY – ASSUMPTION OF RISK

10.1 The Guest expressly assumes all risks associated with staying at and using the Villa.

10.2 The Owner shall not be liable for:

  • Personal injury or death
  • Accidents or incidents
  • Loss, theft, or damage to personal belongings

10.3 This applies regardless of cause, including negligence, natural conditions, wildlife, weather, or third-party actions.

11. NO WARRANTIES

11.1 The Villa is provided “AS IS” and “AS AVAILABLE”.

11.2 The Owner makes no warranties, express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Uninterrupted availability
  • Accuracy of descriptions or amenities

12. FORCE MAJEURE

The Owner shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Power outages
  • Acts of God

No refunds are guaranteed under force majeure circumstances.

13. TERMINATION OF STAY

13.1 The Owner reserves the right to terminate the stay immediately without refund if:

  • House rules are violated
  • Unauthorized guests are present
  • Illegal or unsafe activities occur

13.2 Termination does not limit the Owner’s right to claim damages.

14. GOVERNING LAW & JURISDICTION

14.1 These Terms shall be governed by and construed exclusively under the laws of the Republic of Costa Rica.

14.2 Exclusive jurisdiction and venue for any dispute shall be the competent courts of Costa Rica.

15. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

16. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the Guest and the Owner and supersede any prior communications or representations.

17. ACKNOWLEDGEMENT & ACCEPTANCE

By proceeding with a booking and using the Villa, the Guest confirms that they have read, understood, and accepted these Terms & Conditions in full.
